INJUNCTIONS

Otherwise known as injunctive relief, injunctions are remedies that are part of a lawsuit. They seek to force one party to do something or to stop doing something while a lawsuit is pending. on either a temporary or permanent basis.

An unlimited number of situations exist where injunctive relief maybe sought, but examples include:

  • Stopping a party from unlawfully competing
  • Stopping a party from removing personal property or equipment from premises
  • Stopping a party from removing fixtures or other items attached to real property
  • Preventing a party from creating or continuing a dangerous condition.
  • Stopping a party from unlawfully taking financial information and/or assets

Requests made in court for injunctive relief ordinarily occur very early in a lawsuit. They are fast-paced and intense. The outcome of a request for injunctive relief will often have a dramatic impact on the outcome of the case itself.
