Injunctions

Otherwise known as injunctive relief, injunctions are remedies that are part of a lawsuit. They seek to force one party to do something or to stop doing something while a lawsuit is pending. on either a temporary or permanent basis.

An unlimited number of situations exist where injunctive relief maybe sought, but examples include:

  • Stopping a party from unlawfully competing
  • Stopping a party from removing personal property or equipment from premises
  • Stopping a party from removing fixtures or other items attached to real property
  • Preventing a party from creating or continuing a dangerous condition.
  • Stopping a party from unlawfully taking financial information and/or assets

Requests made in court for injunctive relief ordinarily occur very early in a lawsuit. They are fast-paced and intense. The outcome of a request for injunctive relief will often have a dramatic impact on the outcome of the case itself. Thus, determining whether to make a request for an injunction or evaluating and opposing a request for an injunction is critical and requires immediate legal advice.

If you believe you or your business may be entitled to injunctive relief, or need to determine whether to oppose a request for injunctive relief, contact Schwartz Law. Our attorneys can and will quickly evaluate and advise you as to the best course of action.
