Mass Mutual appears to be using the technique of suing claimants on a more consistent basis for a refund of benefits already paid. In these lawsuits, many of which have been sucessfully defended by Quadrino Schwartz, the insurer is claiming that it was defrauded and is seeking a refund of all benefits paid. Although suits such as these have been filed by Mass Mutual and others over the years, it appears that there is trend by Mass Mutual and other insurers to increase the number of these suits.
