Key to Victory: Expose Insurance Company’s Hidden Documents

Our client, a CPA, suffered from Multiple Sclerosis and was receiving monthly payments according to the terms of his disability insurance policy. A number of errors on his tax returns and insurance applications came to light, and the disability insurance company sued him, claiming fraud. The insurance company’s lawsuit demanded a return of all monies paid over a three-year period, claiming that they never would have issued the policy to our client if they had had different or additional information at the time the policy was issued.

Following detailed questioning of the head of the insurance company’s underwriting division, we demonstrated the company would have issued a policy to our client by proving that it had done so for other policyholders with similar issues. We also demanded sensitive internal documents and convinced the judge to order the insurance company to turn them over. The insurance company was so concerned about revealing these materials and losing the case that they dropped the suit entirely.
