Successful Disability Lawsuit for 911 Worker

A corrections officer who worked at “the pile” at the site of the New York September 11th tragedy needed help in suing his disability insurer, but he had no funds to pay for a lawyer. Our firm took on his case at no charge and began the legal battle on his behalf in earnest.

The client suffered from headaches and respiratory problems as a result of his exposure to the conditions at the site. Prior to our involvement, the insurer had a doctor examine the client, supposedly as an independent examiner. That doctor concluded that our client was not disabled, resulting in the denial of the claim.
We challenged the facts, challenged the medical conclusions, and thoroughly investigated the case. We filed a lawsuit and pursued it aggressively. We convinced the judge to promptly order another medical examination to assist in evaluating the disability. The subsequent examination revealed findings favorable to our client and we were able to then obtain a successful resolution for our client at a relatively early stage of the litigation.
