When a debilitating case of rheumatoid arthritis and injuries from a hit-and-run car accident combined to make a full day’s work impossible, a man filed a claim on a disability insurance policy he had purchased from a major insurance company. After paying monthly benefits for two years, the insurance company started a sting operation to build a case against him. It almost worked, and then it backfired.
Before hiring us, our client was arrested and charged with insurance fraud. His previous attorney didn’t readthe insurance contract and was not familiar with disability insurance law. We convinced the criminal court to re-open the criminal case and all of the criminal charges against him were vacated. Then, the insurance company that had initiated the prosecution and denied the claim reversed its course and paid a large settlement to our client. The District Attorney dropped all criminal charges.
